Raleigh County Prosecutor Ben Hatfield said he waited for a full report from the state medical examiner’s office before filing charges in the case.
A death certificate obtained by the Register Herald said the assault on Mr Cunningham contributed to his death, with injuries to his head, chest and abdomen, but listed the cause of death as coronary artery disease. The cause of death is listed as homicide.
