A routine walk on a San Diego sidewalk has led to a staggering $35 million claim against the city.
A 70-year-old man is taking legal action after tripping on a damaged sidewalk, resulting in a broken neck and back. If not settled soon, the case might head to court.
According to attorney William Berman, the incident occurred in May when the man and his wife were leaving a sushi restaurant at Washington Street and Albatross Drive. He shared details in an interview with NBC San Diego.
Surveillance footage shows the man approaching a car parked at the curb, and while he holds a cane in his left hand, he doesn’t seem to be using it as he walks.
In the video, the man suddenly trips over the exposed base of a parking meter that had reportedly been removed from the sidewalk over a year ago.
The fall was shocking, marked by him crashing headfirst onto the pavement and then landing between the curb and a parked car, where he stayed motionless until his wife came to him.
The incident was recorded outside a nearby veterinary clinic, highlighting a potentially hazardous situation. Berman contends that the city removed the parking meters but neglected to clear away the raised metal bases and protruding bolts, posing a risk. He also notes that similar dangers are present in other areas of the city.
Berman pointed out, “The bases extend about one to two inches above the sidewalk. The city should ensure these bases are completely removed.”
Despite being released from the hospital, the man allegedly now needs round-the-clock medical assistance at home.
A spokesperson for the city stated that they couldn’t comment on the situation or any ongoing legal matters.
