Alina Habba’s Future as U.S. Attorney in New Jersey Uncertain

The future of Alina Habba, the U.S. attorney for New Jersey, became uncertain Tuesday when a district court judge decided not to keep her in that position.

Habba’s 120-day term came to an end on Tuesday, and after deliberating about her potential extension behind closed doors on Monday, judges opted to replace her with Desiree Grace, her top assistant and a seasoned lawyer. Grace will assume the role temporarily starting Wednesday.

Habba, known for her role as former President Donald Trump’s personal and legal spokesperson during his campaign, has stirred up some controversy since her ascent to the position of U.S. attorney.

She made headlines earlier this year when Newark’s Democratic mayor, Ras Baraka, arrested her for allegedly trespassing at an immigration detention facility. The charges were quickly dropped by Habba, leading the judge to reprimand her for that decision. Baraka is now suing Habba for defamation and damages.

Moreover, Trump expressed his desire to keep Habba on as U.S. attorney and had even considered nominating her for a four-year term. Despite some law enforcement officials supporting her as a tough prosecutor focused on street crime, others have criticized her for lacking prosecution experience and for the political nature of her role. For instance, she had previously stated her ambition to “turn New Jersey Red” on a right-leaning podcast.

Currently, it seems she has no viable path to confirmation, especially after New Jersey Senators Cory Booker and Andy Kim expressed their discontent with her nomination via a Blue Slip.

In a somewhat similar situation, Trump has managed to revive U.S. attorneys in the Upstate New York area temporarily. Fox News Digital has reached out to the White House for comments on the matter.

Deputy Attorney General Todd Blanche defended Habba on Monday, arguing that the criticisms from Senators and minority leader Hakeem Jeffries were simply part of a “smear campaign.” He stated that Habba “has full confidence in the DOJ’s leadership and is focused on her work,” emphasizing that a district judge should not be swayed by political pressures.
