Senate approves Emil Bove to be a judge on the U.S. Appeals Court

Emil Bove Confirmed as Judge for the Third Circuit

On Tuesday, the Senate officially appointed Emil Bove as a lifetime judge for the Third U.S. Circuit Court of Appeals, a position originally linked to former President Donald Trump.

Bove received confirmation with a narrow 50-49 vote, securing his role within a circuit that will oversee lawsuits across Delaware, New Jersey, and Pennsylvania.

Notably, Republican Senators Lisa Markowski from Alaska and Susan Collins from Maine opposed the nomination, aligning with Democratic senators in their dissent.

Democratic senators raised concerns about Bove’s nomination, referring to a whistleblower from the Justice Department who alleged that he had “deliberately misinterpreted” details during his time as leading Associate Attorney General under Pam Bondi since January 2025.

Bove assumed this senior position shortly after Todd Blanche was named Deputy Attorney General in March 2025, which followed Trump’s presidency. A whistleblower specifically claimed that Bove had engaged in questionable exchanges regarding accusations against Mayor Eric Adams of New York. In his defense, Bove suggested that shifting policies made such actions acceptable.

In a separate incident, another whistleblower, Erez Roubeni, alleged that Bove instructed his team to disregard a court order preventing Trump’s deportation efforts. During a meeting, he reportedly expressed that the DOJ should consider defying such orders, although Bove later claimed he couldn’t remember using any expletives but acknowledged the significance of future operations.

Roubeni, a former DOJ employee, was dismissed after allegedly providing incorrect information to a judge regarding a case tied to an illegal immigrant, Kilmer Abrego Garcia, who faced deportation errors.

Addressing these accusations, Deputy Chief of Staff Stephen Miller defended Bove, arguing that Abrego Garcia posed a significant threat due to alleged connections with MS13. He also characterized Roubeni as dishonest and labeled him a “sabotager” aligned with Democrats.

After the confirmation vote, Senate Minority Leader Chuck Schumer criticized the decision, suggesting that Bove, whom he called a “henchman of Trump,” harbors extreme views that undermine legal principles and democratic norms.

Democratic senators Corey Booker and Adam Schiff have called for an investigation into Bove’s actions.

On the other hand, GOP Senator Chuck Grassley supported Bove, praising his legal background and commitment to service, while also denouncing what he termed as unfair attacks by Democrats.

Attorney General Pam Bondi congratulated Bove following the confirmation, expressing her belief in his capabilities and dedication.

“Congratulations to Emil Bove on his confirmation! This is a significant day for our nation,” she shared. “His work and support have often gone unnoticed, yet he will prove to be an exceptional judge.”
