States with Democratic leadership take legal action against Trump administration over attempts to cut funding for Planned Parenthood.

A coalition of Democratic state leaders filed a lawsuit this week against provisions from the Trump administration that aim to limit funding for abortion providers.

The lawsuit was initiated by 22 attorneys general, along with Pennsylvania Governor Josh Shapiro. California Attorney General Rob Bonta stated during a press conference that these provisions act as “punishment for advocacy” related to constitutionally protected abortion rights.

“It’s really hard to ignore hypocrisy. It seems that parties who claim to be defenders of free speech only care if it matches their own agenda,” he added.

In a related case, Democrats also filed a lawsuit in Massachusetts where a judge appointed by Obama recently granted a preliminary injunction that requires Medicaid funds to continue flowing to affiliates of the impacted organization while the legal proceedings are ongoing.

The Democrats claim this provision violates the First Amendment and targets specific abortion providers, like Planned Parenthood, effectively blocking Medicaid funds unless clinics meet certain financial criteria.

Although Planned Parenthood isn’t mentioned explicitly, it is one of the few providers affected by these new restrictions. Interestingly, another organization in Maine has also filed a lawsuit in response to similar issues.

Planned Parenthood argues that the cut to Medicaid funding will lead to “devastating effects” on their ability to operate, with estimates suggesting that around 200 clinics could be “at risk of closure” due to these funding measures.

The Senate managed to bypass the 60-vote threshold typically needed for expenses by using a settlement process. Although the Hyde amendment restricts federal funds for abortions unless in cases of rape, incest, or to save a mother’s life, opponents argue federal funds shouldn’t support any abortion-related organizations.

Previously, the Department of Health and Human Services had voiced opposition to lawsuits from abortion organizations arguing that they shouldn’t receive taxpayer money, stating that “the courts should not invent such rights.”

“The courts should support the legitimate exercise of Congress to decide who taxpayers should entrust their hard-earned dollars to,” read their statement.

Planned Parenthood’s recent annual report showed a record number of abortions and a significant increase in taxpayer funding, totaling approximately $792.2 million—around $100 million more than the previous year.

The ongoing case is California vs. HHS No. 1: 25 cv-12118 in the U.S. District Court for the District of Massachusetts.
