Federal judge dismisses Pennsylvania teen's lawsuit concerning transgender athlete

A Pennsylvania teenager has initiated legal action after being compelled to compete against a transgender athlete. Aislin Magalengo, a cross-country and track runner from Quakertown Community High School, filed the lawsuit against the Pennsylvania Interscholastic Athletic Association (PIAA). The case concerns an event at Plymouth Whitemarsh High School during a September 2024 competition.

In that competition, a fellow runner, Allen, claimed first place while Magalengo secured second. The legal challenge claims that Magalengo had to continue racing against Allen throughout the season.

On August 1, U.S. District Court Judge Wendy Beetlestone dismissed the lawsuit. Appointed by former President Barack Obama in November 2014, Judge Beetlestone expressed that the complaints did not provide sufficient evidence of intentional discrimination. She noted that Magalengo failed to demonstrate how students assigned female at birth were treated differently from those assigned male at birth.

The lawyer representing Magalengo, Keith Altman, announced plans to appeal the ruling. He conveyed that his client is understandably disappointed and firmly believes in the case’s significance. Altman added that they intend to continue advocating for this critical issue.

He commented on the broader implications of the case, suggesting that it seems fundamentally unfair for individuals who identify as women to compete against biological females, questioning the fairness in terms of physical capabilities.
