Harvey Weinstein prepared to confront jurors for the third time on rape accusation following surprising split decision at retrial in New York City

Harvey Weinstein is set to confront a third jury regarding rape allegations after experiencing a mixed verdict during his retrial in Manhattan, as stated by his attorney on Wednesday.

Arthur Adara, Weinstein’s legal representative, indicated that the former Hollywood mogul is determined to clear his name.

“We’re ready to go,” Adara told the judge when Weinstein made his first appearance in Manhattan Supreme Court since the split verdict issued in June.

On June 11, the jury found the ex-Miramax executive guilty of sexually assaulting Miriam Haley, a former assistant on “Project Runway,” in 2006, though he was acquitted of charges related to Polish model Kajasokola.

The jury was deadlocked on the case involving the 39-year-old Mann, who alleged that Weinstein, now 73, raped her in a hotel room in Manhattan in 2013, which resulted in no verdict for that count.

Assistant District Attorney Nicole Brunberg informed the court that the prosecution is “ready to proceed” with another attempt to prosecute Weinstein for the rape.

However, Judge Curtis Farber deemed the proposed schedule “unacceptable,” noting that the date had initially been suggested for the fall.

He stated that a new trial must take place by year’s end. Weinstein expressed that no other counts would be settled until the current issues are resolved.

Farber instructed all parties to return to court on September 30, mentioning that if any pending matters are addressed, he would then set a new trial date or deliver a sentence as necessary.

Outside the court, Adara mentioned that Weinstein is keen to move forward and is not interested in plea deals.

“He doesn’t want the word rape associated with him,” Adara shared.

Weinstein was previously convicted in 2020 for sexual assault amid the #MeToo movement and was given a 23-year prison sentence. This conviction was later overturned by an appellate court in 2024.

He also faced conviction in Los Angeles in December 2020 for similar offenses and received a 16-year sentence.

Manhattan District Attorney Alvin Bragg announced in June that following Mann’s agreement to testify again, his office would pursue prosecution once more.

“I will never give up on myself and will make sure my voice and truth are heard. I’ve informed the district attorney that I am willing to endure this repeatedly until justice and accountability are achieved,” Mann stated at the time.
