Transgender athlete files lawsuit after losing women's volleyball scholarship

Emma Morquecho, a transgender volleyball player who was assigned male at birth, is suing Westcliffe University along with the National Association of Intercollegiate Athletics (NAIA). The Mexican American Legal Defense and Education Fund (MALDEF), a civil rights organization, has taken up her case.

Thomas A. Saenz, MALDEF’s president, stated that the Latino community frequently faces discrimination, particularly under misguided biases, and emphasized the need to end discrimination against transgender athletes in California, where many victims belong to the state’s largest racial and ethnic group.

The lawsuit claims that Morquecho informed university officials of her birth gender in 2022 and was granted a scholarship. However, on August 10, 2023, the head coach of the women’s volleyball team emailed her stating she was not eligible to play that fall and that the scholarship was revoked.

Morquecho expressed her resolve to advocate not just for herself but for all quietly struggling transgender individuals, hoping to inspire others to share their own stories about rights issues. She conveyed a vision for a future in which everyone is accorded dignity and respect.

In related developments, President Trump enacted an executive order aimed at keeping biological males out of women’s sports on February 5, which led to the NCAA revising its eligibility criteria the next day. The NAIA had already made changes to its policies in April 2024, allowing biological females to compete in women’s sports but excluding those undergoing hormone therapy from participating in intercollegiate competitions.

Morquecho is now preparing to challenge these regulations in court.
