Salvadoran Migrant Released from Custody

Kilmar Abrego Garcia, a Salvadoran migrant, was released from federal custody in Tennessee on Friday. He is set to return to his family in Maryland, marking the end of his legal proceedings for now.

Abrego Garcia faced charges related to the transport of illegal immigrants within the U.S. While he is free, he will remain under the watch of immigration authorities until his trial, which is scheduled for January 2026.

Upon his release from Putnam County Jail, Abrego Garcia is required to wear a monitoring device and stay in Maryland. The Justice Department had opposed his release, citing concerns about potential danger to the community.

A Maryland judge previously blocked Immigration and Customs Enforcement (ICE) from deporting him immediately upon his release. This decision followed claims from Justice Department lawyers that the government might seek to remove him if he were released pre-trial.

US District Judge Paula Sinis, who dealt with a civil suit concerning Abrego Garcia initiated by his family, mandated that he be given a 72-hour notice before any deportation process begins.

In a hearing last month, Trump administration officials had urged Judge Sinis to hand Abrego Garcia over to ICE custody right after his release, initiating the removal procedures without delay.

Earlier this year, Abrego Garcia was sent back to El Salvador, which contradicted a 2019 order against his deportation. Officials later admitted this incident was a “management error.”

Having entered the U.S. illegally over a decade ago, Abrego Garcia had been residing in Maryland with his family before his deportation. The Trump administration has labeled him a member of the notorious MS-13 gang; however, U.S. judges have dismissed this characterization as baseless. His legal representatives argue that Tennessee prosecutors have been selective in their approach and that the charges should be dismissed for these discrepancies.
