Elon Musk’s company, Xai, has initiated a lawsuit against former employee Xuechen Li, who is described as a “Chinese citizen” accused of stealing confidential information before leaving to join the rival company OpenAI. Musk has been a longstanding advocate for the H-1B visa, bringing engineers from China and India to address what he claims is a lack of talent among American workers.
Xai, an AI enterprise founded by Musk, filed a federal complaint on Thursday, alleging that Li misappropriated its trade secrets prior to starting work at competitor OpenAI. The lawsuit claims that Li, who holds a PhD from Stanford, “willfully and maliciously” copied data to his personal systems on the same day he received approximately $7 million from the company.
The complaint details that the stolen trade secrets include advanced AI technology that boasts features surpassing those of ChatGPT and other similar products. Xai asserts that this stolen technology could potentially save OpenAI and its rivals billions in research and development costs and a significant amount of time.
Li, originally from China and residing in Mountain View, California, joined Xai in early 2024. The lawsuit alleges that he took various measures to cover up his actions, such as deleting browser histories and system logs, renaming files, and compressing data before uploading it to his own systems. Xai contends that Li verbally confessed to appropriating confidential information in a handwritten note and attempted to conceal the theft.
Just three days after allegedly transferring Xai’s data to his personal systems and receiving a substantial payment from the company, Li resigned on July 28th, 2024. The lawsuit claims that he had accepted an offer to join OpenAI, with a start date set for August 19th.
After his departure, Li returned the company’s property, deleted the copied files, and signed an agreement to maintain confidentiality. However, Xai disputes the validity of these claims. Musk is seeking a restraining order to prevent Li from working at OpenAI while the matter regarding the stolen secrets is addressed.
The ongoing support for foreign workers under the H-1B visa program may have contributed to his earlier confrontations with segments of the conservative movement.
As reported by other sources, Musk remains a staunch proponent of the H-1B visa program. In a recent social media interaction, he mentioned the necessity of optimizing the program, referring to his view that the underlying issues shouldn’t exist in the first place.
“My presence in America owes a lot to the H1-B visas, along with companies like SpaceX and Tesla that have played a significant role in strengthening the nation,” he expressed, responding to critics on social media. “Let’s take a bold stand on this matter.” His comments were reminiscent of lines from a popular comedy film.
This incident is not Musk’s first controversial remark in the ongoing debate surrounding the H-1B visa, having previously criticized users who disparage the program and calling for their exclusion from the Republican Party, though he later clarified that his remarks were aimed at specific individuals embodying hate and racism.
