American judges are facing significant threats. According to a recent report by the U.S. Marshals Service, one-third of federal judges received threats last year, with over 500 instances recorded in the past 11 months. This trend has grown noticeably, putting judges and their families in precarious positions.

Many of these intimidation attempts stem from influential figures within the administration, particularly when judges make rulings that clash with the administration’s goals. Politicians and commentators from the Democratic side have not shied away from launching attacks against Supreme Court justices with whom they disagree.

This situation might be tempting to dismiss as just another fierce political chapter. However, concerns about judicial independence have persisted across multiple administrations, whether Democrat or Republican. The current climate feels different—more intense and disruptive. Rhetoric is escalating, with some public officials openly questioning the judiciary’s role and its constitutional boundaries.

This phenomenon poses a serious risk to the foundations of our legal system, and it should raise alarms for us all.

It’s not enough just to denounce these threats—we need to actively support judges and legal professionals who are standing firm against these attacks. As someone involved in legal education, it’s crucial to instill in future lawyers a respect for the courts and the rule of law. An independent judiciary, backed by a courageous legal profession, is fundamental to both democracy and a thriving economy—this truth remains constant across different administrations.

Consider the broader implications of threatening judges: it could lead to chaos that ripples through federal, state, and local courts. Our judicial system hinges on the independence and integrity of judges, which can be compromised by political opportunism. When judges are targeted, it threatens the legitimacy of the entire system, impacting not just politically charged cases but also everyday legal matters that affect all aspects of life.

Last year, approximately 750,000 cases were pending in U.S. District Courts, while state courts processed 60 to 70 million cases annually, dealing with a multitude of issues—family law, property disputes, employment matters, and more. Even transactional work hinges on a rule of law upheld by an independent judiciary. It’s the cornerstone of our legal system.

Courts often handle weighty constitutional matters, yet their role is vital in protecting individual rights and ensuring governmental accountability. This is a demanding role, and most judges approach it with integrity.

For our judicial system to thrive, we need judges who prioritize fairness and community over political influence. Certain states emphasize capability and character over ideology during judicial appointments. Yet, the ongoing attacks on the judiciary may discourage qualified individuals from seeking these roles, contributing to a concerning trend of vacant judicial positions.

As legal professionals, we have a responsibility to defend judges facing hostility. We must urge political figures and commentators to cease undermining judicial authority. It’s crucial for leaders and their teams to refrain from behavior that was once unacceptable. We recognize the pressures on law firms amid these unprecedented challenges, but maintaining judicial and professional independence is non-negotiable.

This requires a concerted effort from all law schools, lawyers, bar associations, and legal organizations to combat misinformation and reinforce the judiciary’s significance. Legal practitioners must push back against labels like “corruption” or “activism” directed at judges merely performing their duties according to the law. Now is the time for us to collectively reject threats and attacks against our judicial system.

When we took our oaths, we pledged to uphold the Constitution. Today, that oath is under scrutiny, and it’s imperative for each of us to advocate for the foundational tenets of our legal system. The integrity of our courts and the health of our nation depend on it.
