Immigration Judge Denies Asylum Bid from Kilmer Abrego Garcia
A Baltimore immigration judge has turned down Kilmer Abrego Garcia’s request for asylum, which he had first pursued back in 2019. While this ruling isn’t the end of the road, as he has a month to appeal to the Immigration Appeals Committee, it certainly puts him in a tough spot.
Garcia, who is a citizen of El Salvador, has lived in Maryland for years with his American wife and children. His journey to the U.S. started when he immigrated illegally as a teenager. After being arrested by immigration authorities in 2019, he sought asylum, but his application was denied because he had been in the country for over a year. Nevertheless, the judge recognized that deporting him to El Salvador would pose serious dangers due to gang threats against his family.
His case stirred significant controversy after he was mistakenly deported to El Salvador last March. That event highlighted the harsh immigration policies of the Trump administration and sparked protests against these measures. Although the U.S. Supreme Court ruled in his favor and brought him back in June, he soon faced allegations of human smuggling.
Currently, Garcia is confronting criminal charges stemming from a traffic stop in Tennessee in 2022. Additionally, U.S. immigration authorities are attempting to deport him to a third country, initially considering Uganda and then Eswatini. His legal team has criticized both the criminal charges and the deportation attempts, suggesting they are retaliatory actions against him for resisting authority.
