Family Sues After 4-Year-Old’s Tragic Death in California Park

A 4-year-old boy lost his life in a California park when a eucalyptus branch fell on him, leading his family to file a wrongful death lawsuit. They argue that the tree had been in decline for many years.

Ronan Kerr was struck on the head by a large branch while playing at Villa La Jolla Park in San Diego this past June, as detailed in a GoFundMe campaign created for his family.

He was with his father, Cathal, and his 7-year-old brother, Charles, when a 34-foot branch fell from a height of 60 feet, according to the lawsuit. Reports indicate that Cathal tried to catch Ronan in the nick of time but wasn’t able to reach him before the branch fell.

Sadly, Ronan died after a week in the hospital, as stated in the legal complaint.

Cathal also sustained severe injuries, including a traumatic brain injury along with facial lacerations and fractured bones.

The lawsuit targets both the city of San Diego and the contractors responsible for maintaining the park’s trees. It asserts that the branch that struck Ronan was obviously unhealthy and rotting.

Details from the lawsuit suggest that the tree’s limbs were large, heavy, and poorly maintained, indicating the risk of collapse was clear to anyone trained to assess such matters.

Allegations in the lawsuit indicate that at least 30 incidents of falling branches, including those at Villa La Jolla Park, have been recorded since 1983. In one of the more tragic instances from that year, another 4-year-old was killed by a falling branch at the San Diego Zoo entrance. Additionally, a 2013 incident on the campus of the University of California, San Diego, left a pregnant woman and a man injured.

The lawsuit warns that eucalyptus trees in San Diego parks represent a significant threat to public safety, claiming that current city inspection and maintenance efforts are grossly inadequate.

To address these concerns, the lawsuit calls for the removal or control of all eucalyptus trees deemed dangerous in parks and schoolyards, alongside timely inspections and public dissemination of risk assessments.

In an emotional obituary, the Kerr family described Ronan as a “lover” and “kind soul,” noting that he brought joy to everyone around him. His family highlighted his love for his brother and his desire for connection, making clear that family meant everything to him.

As of now, attorneys for both the Kerr family and the city of San Diego have yet to respond to inquiries for comment.
