Freedom Caucus Members Support Russ Vought's Action to Stop Illegal Funding by the Fed

Accountability in Financial Oversight

Chairman of the House Freedom Caucus, Andy Harris (R-Md.), along with Rep. Marlin Stutzman (R-Ind.), voiced their support for Russ Vought, the acting director of the Consumer Financial Protection Bureau (CFPB). They aim to bring accountability to the American people by halting unauthorized financing through the Federal Reserve.

Recently, the CFPB announced via a court notice regarding the case NTEU vs. Vought. The Department of Justice’s Office of Legal Counsel (OLC) has determined that, under the Dodd-Frank administration, it currently cannot legally request funds from the Federal Reserve.

The OLC’s review indicated that the Federal Reserve doesn’t have the “total revenues” required from the CFPB as stated by the Dodd-Frank Act. Opinions from the OLC are binding for enforcement agencies, including the Secretariat. It’s anticipated that the existing funding will last until year’s end.

“The CFPB’s funding system under Dodd-Frank is unworkable and irreparable,” Harris stated in a communiqué to Breitbart News. “The agency lacks a legitimate funding source, and it’s high time to dismantle this unaccountable entity, restoring financial oversight to a transparent and constitutional framework.”

Stutzman, who serves on the House Financial Services Committee, appreciated this development, suggesting it would lead to improved accountability. Conversely, Sen. Elizabeth Warren (D-Mass.), who originally conceived of the CFPB, designed it to reduce its accountability to Congress and, by extension, to the public.

“Since its establishment, the CFPB has evolved into an opaque bureaucracy with expansive powers, often prioritizing political agendas over sound policies,” remarked Hoosier Conservatives to Breitbart News.

“We’ve repeatedly seen how Democrats have leveraged the CFPB to disrupt functioning markets and restrict consumer financial freedom. I firmly support Director Vought’s commitment to ensuring accountability to the American people and will endorse policies that enhance competition and yield beneficial outcomes for everyone.”

The CFPB traditionally relies on transfers from the Federal Reserve instead of direct congressional funding. Although the proposed Big Beautiful Act couldn’t fully eradicate the CFPB, it’s a significant legislative effort from President Trump during his administration. The budget cap runs from 12% to 6.5% of the Fed’s operating costs.

The Trump administration, along with OMB and CFPB teams, has worked to limit the CFPB’s capacity to target U.S. businesses through regulatory enforcement.

CFPB Chief Legal Officer Mark Paoletta stated, “The most crucial action we can take now for freedom, the rule of law, consumers, and American businesses is to put an end to these lawsuits.”
