Judge Orders Release of Illegal Immigrant from Custody
A judge is asking the Department of Homeland Security to release Kilmer Abrego Garcia, a prominent illegal immigrant, from custody while awaiting deportation.
On December 11, Judge Paula Kishinis, appointed by President Barack Obama, stated, “Defendant must immediately release Abrego-Garcia from ICE custody.” In a subsequent directive, the judge noted that:
Defendant must inform Abrego-Garcia’s attorney at least four hours before release about the exact time and location. The court should be notified about his release status by email no later than Thursday, December 11, 2025, at 5:00 p.m.
Tricia McLaughlin, DHS’s top spokesperson, criticized the ruling. “This is a naked judicial act by an Obama-appointed judge,” she stated. “This order lacks a valid legal basis, and we will continue to fight it vigorously in court,” she added.
Immigration advocacy groups have rallied behind Abrego-Garcia, providing him with high-profile legal representation. They have sought to involve President Donald Trump in various lawsuits aimed at limiting the impacts of illegal immigration, which some believe affects job stability for U.S. citizens. While the legal battles are costly, they argue they help safeguard laws meant to protect everyday Americans from unchecked immigration.
Various Democrats have stood by illegal immigration, despite serious allegations against Abrego-Garcia, including accusations of being an illegal immigrant. His past includes incidents of domestic violence and alleged ties to the MS-13 gang, as well as involvement in labor trafficking.
However, this legal conflict appears to be politically unfavorable for Democrats. A recent Harvard/Harris poll indicated that a significant portion of registered voters, around 62 percent, now thinks he is likely a member of MS-13.
In October, another judge had already sanctioned a “final deportation order” concerning illegal Salvadoran immigrants.
Earlier, in August, Tom Homan, the White House Deportation Director, had harsh words for Abrego-Garcia, describing him as “a gang member, a human trafficker, a wife beater, a child predator, and an illegal alien criminal.” He labeled him a significant risk to public safety and mentioned that two different federal judges had ordered his removal. “He has been charged with human trafficking and alien smuggling. He is a bad man. I promise he will be expelled from this country,” Homan declared.
“I’ve been very committed to this, and I’m not going to let it go,” he added.
