Minnesota Confronts Another Challenge as Federal Funding is Threatened by the Trump Administration

Potential Loss of Federal Funding for Minnesota Department of Education

The Minnesota Department of Education is facing a serious risk of losing federal funding from the Department of Education (ED) and the Department of Health and Human Services (HHS). This situation arises after the department allegedly violated Title IX by permitting men to compete in women’s sports, and, according to reports, they have declined to engage in negotiations with the government following an investigation.

The inquiry by ED and HHS has led them to refer the Minnesota Department of Education to the Department of Justice (DOJ) for possible law enforcement action. This referral follows findings that the state allowed men to join women’s sports teams, which goes against Title IX regulations.

Investigators from ED and HHS looked into potential Title IX violations involving the Minnesota Department of Education and the Minnesota High School League (MSHSL). They discovered that ED and HHS had proposed resolutions that could have voluntarily addressed the Title IX issues, but the Minnesota Department of Education chose not to accept these offers.

Due to this refusal, the matter has been escalated to the DOJ, which could ultimately lead to the loss of federal funds allocated to Minnesota’s education and health services. The implications are significant, as emphasized by Education Secretary Linda McMahon, who remarked that despite having several chances to comply with Title IX standards, the state has opted to defy them, putting the safety and fair competition opportunity for women and girls at risk.

Furthermore, amidst a scandal involving Governor Tim Walz, the referral to the DOJ illustrates Minnesota’s failure to protect its citizens and follow legal standards, according to McMahon. She indicated that the Trump administration is committed to holding Minnesota accountable for its actions.

Additionally, ED and HHS found multiple instances where the Minnesota Department of Education and MSHSL violated Title IX by allowing male athletes to participate in various women’s sports teams, including alpine skiing and lacrosse. They presented a resolution agreement that demands the state prohibit male participation in women’s sports and redefine biologically-based categories. This agreement also requires annual certifications to ensure adherence to Title IX regulations.

Interestingly, the recent executive order from President Trump, which bans biological males from participating in women’s sports, was enacted shortly after he took office. This move was, in part, a reaction to former President Biden’s administration expanding Title IX protections to include gender identity, which created a clash of policies between the two administrations.

Health and Human Services Secretary Robert F. Kennedy Jr. added his stance, stating that Minnesota’s actions are a violation of Title IX. With the refusal to comply with federal regulations, the state now finds itself under scrutiny from the DOJ for potential enforcement measures.
