HHS Repeals Abortion Pill Dispensing Requirement for Pharmacies

The Department of Health and Human Services (HHS) has repealed a rule from the Biden administration that mandated pharmacies to provide abortion pills. This requirement was initially enforced during President Biden’s tenure, when around 60,000 retail pharmacies were notified they needed to dispense abortion pills to patients covered by Medicare, Medicaid, or other federal funding. This directive came in response to the Supreme Court decision that overturned federal abortion rights and transferred authority back to the states.

In 2023, the Supreme Court ruled in favor of religious pharmacies that challenged Biden’s abortion mandate, prompting a shift in policy. However, some critics argue that this policy change still leaves pharmacies in a bit of a confusing situation.

This week, the Trump administration announced it was taking steps to reverse Biden’s policies, stating it aligns with a national effort to prevent federal funds from being used to promote elective abortion.

The HHS Office for Civil Rights recorded the rescinded policy in the Federal Register, noting that the previous guidance could still be viewed as a means to use taxpayer money to promote abortions and might compel pharmacists to participate in practices that conflict with their personal beliefs.

Matt Bowman, a senior adviser at Alliance Defending Freedom (ADF), mentioned that the adjustments made after the Supreme Court’s decision still pose risks to pro-life pharmacies across the country. ADF is representing Pro-Life Pharmacy in a case against the Biden administration.

Bowman expressed gratitude for the current administration’s decision to fully eliminate the remnants of the previous abortion mandate, stating it protects pharmacies that wish to refuse to stock or dispense abortion pills.

Moreover, the Trump HHS has also abolished the use of the term “pregnant person,” emphasizing that only women and girls can experience pregnancy.

The recent HHS action coincides with the Food and Drug Administration (FDA) requesting a federal court to suspend a lawsuit in Louisiana aimed at limiting mail-order sales of abortion pills. The administration has called for a pause until a thorough safety review of the drug is completed.

Pro-life advocates and Republican leaders are urging the Trump administration to cancel the Biden administration’s mail-order abortion plan and finalize safety assessments for abortion pills.
