Federal judge shows doubt as Kelly contests Pentagon reprimand

Judge Considers Case on First Amendment Rights for Sen. Mark Kelly

A federal judge seemed to validate concerns raised by Sen. Mark Kelly (D-Ariz.) regarding possible retaliation from the Pentagon against his political speech, which could infringe upon First Amendment rights.

U.S. District Judge Richard Leon is weighing the possibility of issuing a preliminary injunction to pause Army Secretary Pete Hegseth’s ongoing efforts to adjust Kelly’s military retirement grade. This adjustment could lead to a decrease in his pension while the case unfolds.

“You don’t need a weather forecaster to tell you which way the wind is blowing,” Leon remarked, quoting Bob Dylan. This suggests he believes the evidence of Kelly’s First Amendment rights being infringed is quite apparent.

The background of this issue dates back to a social media video from November, where Kelly and several other Democratic lawmakers encouraged military personnel to ignore illegal orders.

In a notable communication, Hegseth had censured Kelly on January 5, claiming he had undermined military command and incited insubordination.

Shortly after, Kelly filed a lawsuit against Hegseth, arguing that the censure and attempts to alter his military grade were unconstitutional acts of retaliation for his protected political speech.

Kelly’s legal team emphasized that this situation is unprecedented, noting that Hegseth has openly stated he is penalizing a decorated veteran and senator for exercising First Amendment rights.

On the other hand, attorneys representing Hegseth contended that as a retired officer, Kelly is still bound by the Uniform Military Justice Act, and his comments could disrupt order and discipline within the armed forces.

They also raised concerns that a judge’s injunction might limit governmental oversight over military personnel.

While Judge Leon did not announce a verdict in court, he recognized that Kelly was aware of an approaching deadline and aimed to issue a decision soon.

After the tense hearing, Kelly expressed that the case extends beyond his individual rights; it’s about the rights of all veterans. “This administration has continually challenged the First Amendment rights of Americans,” he stated. “That’s not the American way. We rely on the Constitution and the law.”
