Federal Ruling on Mark Kelly’s Case
A federal judge has placed a temporary hold on disciplinary actions against Arizona Democratic Senator Mark Kelly, triggered by a video in which he urged U.S. military personnel to reject illegal orders from their superiors.
U.S. District Judge Richard Leon determined that Kelly’s First Amendment rights were infringed upon by Pentagon officials. He asserted that this disciplinary measure “endangers the constitutional rights of millions of veterans.”
In November 2025, Kelly and five fellow Democrats posted a video reminding military members of their obligation not to comply with unlawful orders.
The Pentagon criticized this message as suggesting that the military could dismiss lawful commands, labeling it treasonous behavior. Pete Hegseth remarked that the video was “reckless and inflammatory” and intended to compromise military order and discipline.
President Donald Trump responded at the time, expressing that, “Those who encouraged military disobedience should be jailed, not free to spread misinformation.” He characterized such words as severe incitement, emphasizing the gravity of the situation.
On social media, Kelly reflected on the court’s decision, stating, “Today, the court confirmed that Hegseth’s punitive actions against me breached the Constitution.” He emphasized the importance of holding the administration accountable for upholding American rights, expressing a belief that the conflict may not be fully resolved, as Trump and Hegseth may struggle to accept their errors.
Hegseth also commented on the ruling via social media, reiterating that they would pursue an appeal, stating, “Incitement is incitement, ‘Captain.'” He emphasized the serious nature of the situation.
In a related remark, Kelly quoted from the judge’s conclusion, highlighting that rather than aiming to limit veterans’ First Amendment rights, Secretary Hegseth and others should acknowledge the valuable perspectives veterans contribute to discussions about military issues.
