Woman in anti-Trump penis costume cleared of charges

A woman donned an inflatable phallus costume to protest the Trump administration at the Fairhope Courthouse in Alabama.

On October 20, 2025, footage from police body cameras captured a 62-year-old woman being pushed to the ground by an officer after she refused to remove the costume during a No Kings protest.

Her attorney argued in court that the arrest was a violation of her constitutional right to free speech. While police claimed the costume was offensive, there was no immediate charge related to causing a traffic hazard, which later became part of the case against her.

“He just made her feel uncomfortable,” David Gespas, her attorney, explained outside the courthouse. He noted that the officer’s testimony mostly revolved around not tolerating the costume in his town, rather than any actual traffic disruption.

In response, Fairhope City Attorney Marcus McDowell contended that there is no constitutional right to wear such a “seven-foot penis onesie” on the roadside. Despite this, Judge Haymes Snedeker found the woman not guilty on three charges and dismissed the traffic hazard claims, concluding that while the officers had probable cause, there wasn’t enough evidence to prove her guilt beyond reasonable doubt.

Following the verdict, the woman expressed her determination, stating, “We need to grow and relearn the rights that residents of this town have… this fight is not over yet!”

In light of the incident, some locals expressed disappointment with the verdict, while others noted that it brought national attention to Fairhope.

Before her arrest, she had been carrying a placard that conveyed a message opposing the administration, aligning with the theme of her costume.
