Elon Musk and Sam Altman Face Off in Court

The long-anticipated lawsuit between Elon Musk and Sam Altman kicked off on Monday in California. As the courtroom drama unfolds, it’s likely to spark plenty of gossip and scandal from the Silicon Valley scene in the days ahead.

Both Musk and Altman are central figures in the case, which centers on allegations that Musk violated a commitment to keep OpenAI as a nonprofit and share its technologies openly. Testimonies are expected from Siobhan Gillis, a former board member who is accused of surveilling OpenAI while maintaining a personal relationship with Musk.

In the proceedings, evidence mentioned by OpenAI includes a text exchange between Musk and Gillis, who, shortly before Musk stepped down from OpenAI’s board in 2018, questioned whether they should continue being “close and friendly” with OpenAI to “keep the information flowing.” Musk replied, affirming their connection while mentioning they were transitioning several individuals from OpenAI to Tesla.

U.S. District Judge Yvonne Gonzalez Rogers ruled last month that the nature of Musk’s relationship with Gillis raised concerns about her reliability and her role in the OpenAI operations.

Meanwhile, the court has limited certain topics for jurors, even as jury selection began on Monday and the trial is set to start on Tuesday. Notably, judges have restricted discussions about Musk’s alleged drug use, including “psychedelics.” However, the judge allowed inquiries regarding Musk’s presence at the 2017 Burning Man festival, considering its relevance to the negotiations affecting OpenAI’s reorganization at that time.

Other noteworthy court documents released so far include a revealing text exchange where Zuckerberg assured Musk that Meta was diligent about removing posts involving personal threats or information. Musk then sent a heart emoji and suggested collaborating on a bid for OpenAI’s intellectual property.

In earlier communications from 2016, which also surfaced, Musk indicated a preference for collaborating with Microsoft rather than Amazon, describing Bezos as “a bit of a tool.” Another interaction included Altman thanking Musk, suggesting he was instrumental in the existence of OpenAI and expressing distress over Musk’s public criticisms of the organization.

Meanwhile, the lawsuit asserts that Altman and OpenAI co-founder Greg Brockman strayed from the nonprofit’s original goals to benefit personally through the shift to a for-profit structure. Musk has also pledged to donate any financial gains from the lawsuit to charity.

OpenAI has labeled Musk’s lawsuit as “sour grapes,” claiming it’s part of a broader campaign to hinder their progress and promote Musk’s own AI venture, xAI.

Potential witnesses listed include Mira Murati, CEO of Thinking Machines and a former top engineer at OpenAI, as well as Musk’s assistant Jared Birchall, who might provide insight into Musk’s alleged efforts to form a commercial entity using OpenAI’s framework.

OpenAI firmly stated in legal filings that Musk’s actions indicated he favored a for-profit rewrite of their organization’s structure, which contradicts his current claims.
