Visa Enforcement Targets Birth Tourism

The Trump administration is ramping up its efforts to address what’s known as “birth tourism.” This practice involves foreign nationals obtaining visitor visas for the primary purpose of giving birth in the U.S., thereby granting their children American citizenship.

Recently, officials revealed they had disrupted a sizable birth tourism network operating in West Africa, where over 100 individuals had allegedly used fraudulent documents to secure visas. The intention? To have their children born on U.S. soil and benefit from citizenship.

This isn’t an isolated incident. Since 2024, authorities in the U.S. have reported identifying over 400 cases of suspected birth tourism linked to Europe. Investigations have traced many of these activities back to at least six companies that provided guidance on how to navigate visa interviews and organized housing and birth arrangements.

The State Department stated their commitment to ending this issue by revoking the visas of those involved and collaborating with local authorities to eliminate similar networks. “A U.S. visa is a privilege, not a right,” they articulated. “We are taking global measures to stop this abuse, dismantle these networks, and hold accountable those who attempt to mislead the system.”

Senator Blackburn has shown her support for the administration’s immigration policies, underscoring the need to address birth tourists who appear, in her words, to “buy American citizenship.”

This push aligns with President Trump’s ongoing critique of birthright citizenship. Notably, a 2025 executive order aims to redefine who is automatically granted citizenship at birth. This initiative builds on previous guidelines from 2020 that instructed consular officials to deny visas to individuals seemingly traveling primarily to give birth in the U.S.

In a statement to Fox News Digital, White House Press Secretary Anna Kelly emphasized, “President Trump always puts the American people first. Unregulated birth tourism is a burden on taxpayers and poses risks to our national security.” She argued that with these measures, the U.S. would align itself more closely with international norms.

Ira Melman from the Federation for American Immigration Reform also weighed in, noting that visa fraud is a significant issue, extending beyond just the realm of maternity travel. “The allure of birthright citizenship is what drives some individuals to commit visa fraud,” he explained, asserting that women concealing their birth intentions during visa applications are indeed committing fraud. He believes removing the incentive for automatic citizenship would diminish such fraudulent behavior.

Birth tourism has emerged in various capacities in the U.S. recently, particularly among operations accused of instructing foreign applicants to hide their true travel motives. For instance, in California, the operators of USA Happy Baby faced convictions for facilitating travel for Chinese women seeking to give birth in the U.S. There’s also a case involving the owner of You Win USA, who pleaded guilty in relation to a broader crackdown.

In Texas, Attorney General Ken Paxton initiated a lawsuit against a postnatal center accused of facilitating over 1,000 births primarily for Chinese clients. Concurrently, House Oversight Republicans are investigating several U.S. companies linked to promoting birth travel services.

Melman called for more rigorous vetting of visa applicants and suggested that Congress should prosecute those committing fraud. He also advocated for legal measures against companies abroad promoting these activities. “We must pursue legal actions similar to other cross-border criminal cases,” he stated, noting that many of these companies are connected with U.S. service providers, including hospitals.
