Texas judge suspended for allegedly assaulting family member on NYE

A Harris County, Texas, criminal court judge has been suspended due to a “pending criminal case” for allegedly assaulting a family in Galveston on New Year’s Eve.

FOX 26 in Houston reported that Judge Frank Aguilar of Harris County Criminal Court’s 228th District Court has been suspended by the state Judicial Conduct Commission due to a “pending criminal matter,” according to court records.

The commission cited Rule 15A, which states that “immediately after a state or federal grand jury indicts a judge for a felony or for a misdemeanor involving official misconduct,” The law states that a person can be suspended from work regardless of whether or not he or she has.

The rule goes on to provide that a suspended judge must ensure that continuing to serve does not jeopardize the interests of parties involved in court proceedings over which he or she presides or undermine public confidence in the judiciary. He says he is entitled to a post-suspension hearing to prove his case.

Last month, Galveston County authorities formally charged Aguilar with assaulting a family member on New Year’s Eve.

In a probable cause affidavit reported by the station, Aguilar is accused of punching the woman in the face several times before putting his foot on her neck after an argument.

Aguilar’s district is the same venue that handles prosecutions related to the Harding Street police raid in which police killed two innocent civilians, the department said. The case is still in court five years later.
