LIVINGSTON, Texas — Polk County Sheriff Byron Lyons confirmed that law enforcement officials found the body of 11-year-old Audrey Cunningham in the Trinity River under the Trinity River Bridge on Route 59. Audrey Cunningham disappeared in front of school on Thursday, February 15th. .
“We regret to announce that the body of Audrey Cunningham has been found,” Sheriff Lyons said at a news conference Tuesday afternoon attended by Polk County District Attorney Shelly Sitton and other local officials. .
District Attorney Sitton said that appropriate arrest warrants are being prepared for Don Stephen McDougall on charges of secret murder. When asked if her office would seek the death penalty, she acknowledged she would make a decision after further consultation with law enforcement.
The sheriff’s office said it had gathered “substantial evidence” based on investigations from Polk County, San Jacinto County, the Trinity River Authority and others. He thanked the Trinity River Authority for slowing the river to facilitate the search for the girl.
When a Breitbart Texas reporter asked if there was any weight on the girl’s body, the sheriff said he is refusing to release that type of information at this time.
Mr Lyons stressed that he had used technology and information from the public to gather enough evidence to find Mr Audley’s body without Mr McDougall’s statement. Mr. McDougall took investigators over the weekend to the location he visited on Thursday. One of those locations was the Trinity River Bridge.

On Monday, Breitbart Texas asked Sheriff Lyons if McDougall admitted to leaving the house with Audrey on the morning of February 15th. The sheriff replied, “Yes.” He also said McDougall never said he dropped Audrey off at the school bus stop.
“We feel at this point that he is the last person to have seen Audrey,” Lyons said at the beginning of the briefing. She added: “There is information that he sometimes dropped her off at the bus stop and even took her to school.”
