The inmate accused of killing his cellmate in the West Virginia Southern Regional Jail attack has entered into a plea deal.

Lucas Matthew Wagner, 29, on Wednesday entered a plea to Kennedy for second-degree murder in the 2022 death of Douglas Alan Cunningham, 79, the Register-Herald reported. Ta. Kennedy’s plea means the defendant is not admitting guilt but agrees that prosecutors have enough evidence to convict him. According to the agreement, he was sentenced to 30 years in prison.

Raleigh County Prosecuting Attorney Ben Hatfield said the state medical examiner’s report listed the cause of death as a homicide, but the cause was a combination of coronary artery disease and “acute stress.” He said he agreed to plead guilty to a lesser charge. He was injured in the attack.”

The 30-year sentence will follow Wagner’s current sentence of one to five years for child abuse.
