The pro-life movement achieved its goal of overturning Planned Parenthood v. Casey and Roe v. Wade in the conservative-leaning Supreme Court in the summer of 2022. In the blockbuster case Dobbs v. Jackson Women’s Health Organization, the Supreme Court’s opinion, authored by Justice Samuel Alito, ruled 5-1-3: “We believe that Roe v. Casey must be overruled. The Constitution is silent on abortion, and such a right is not implicitly protected by the Constitution.” It includes the Fourteenth Amendment’s Due Process Clause, the provision on which defenders now primarily rely. ”
Simply put, abortion policy is now up to the states rather than the courts. For decades, the conservative pro-life movement has pushed to overturn Roe and allow states to decide abortion policy through their state representatives. And President Trump’s appointment of three Supreme Court justices made this possible. But abortion at the federal level has caused problems with Republicans and voters.
Republicans need to learn how to message this delicate conversation. If they don’t, they could face an undertow heading into November, similar to the 2022 midterm elections. President Trump’s recent policy announcements on abortion are wise. Protect IVF, oppose federal abortion bans, build a pro-life culture, and make exceptions for rape, incest, and maternal health.
President Trump says abortion should be a national decision based on “the will of the people”
Abortion has become an energizing issue for Democrats across the country. Before Roe was overturned, Republicans were bracing for a red wave in the 2022 midterm elections due to Joe Biden’s unpopularity, rising inflation and chaos at the southern border. Even after the historic Supreme Court ruling, polls continued to show positive results for Republicans in purple- and red-leaning Congressional districts, as well as Senate districts in Nevada, Pennsylvania, Georgia, and Arizona.
Nationally, the economy and inflation dominated the conversation, and Republicans had an advantage over Democrats simply because they controlled the White House and Congress, and voters were worried about reckless spending and the border. Because they didn’t like the lack of security. But abortion was an underlying issue in the 2022 midterm elections, according to exit polls. In fact, while inflation was rated as the most important issue for voters, abortion was a close second.
According to NBC News, 32% of voters said inflation was their top issue, and 27% said abortion was their top issue. Voters trusted Republicans by an 8-point margin to address inflation and Democrats by a 10-point margin on abortion. The data found that 39% of voters were angry about the June decision in Dobbs v. Jackson Women’s Health Authority, and an additional 21% of voters were dissatisfied with the ruling.
In comparison, 21% of voters nationwide said they were satisfied with Dobbs’ decision, and an additional 16% said they were enthusiastic about the decision. We won a very slim majority in a year when House Republicans were supposed to have a supermajority. Republicans had high hopes of flipping the Senate, but instead Democrats retained their Senate majority.
Pro-life conservatives are ‘disappointed’ with Trump’s new abortion policy, but stick with him: ‘There’s only one choice’
Heading into the 2024 election, Republicans won on the key issues that matter to Americans: inflation/economy and immigration. Joe Biden remains deeply unpopular as voters disapprove of his handling of key issues, negatively impacting his leadership.
President Trump is in a strong position to win, leading Joe Biden across the country, in key battleground states, and on policy issues that matter to voters. Republicans are on the offensive in the Senate, particularly in Montana and Ohio, states that Trump won in 2020. He has polled ahead of Biden in other races, including Arizona, Nevada and Pennsylvania, making these races prime opportunities for Senate Republican challengers.
Republican campaign officials have been in talks to agree to a 15-week federal abortion ban, highlighting three key exceptions: rape, incest and maternal health.
The politics of abortion policy favors Democrats, not Republicans, and helps independent voters who disapprove of the federal ban on abortion. A record number of Americans say abortion should be legal, according to a recent Fox News poll. This includes increased support among voters 65 and older (+16 points should be legal), conservatives (+12), Republicans (+11), and white evangelical Christians (+10). is included. Voters oppose the 15-week ban by 11 points (54% against, 43% in favor).
The reality governing mathematics also does not match at all. Suppose Republicans win Ohio, Montana, Arizona, Pennsylvania, Wisconsin, Michigan, Nevada, West Virginia, and Maryland. That would leave the U.S. Senate with 58 seats. A federal abortion ban would require 60 votes to pass, with Republican Sen. Susan Collins of Maine and Republican Sen. Lisa Murkowski of Alaska losing two votes.

Additionally, if former Republican Gov. Larry Hogan wins Maryland’s U.S. Senate race, which he supports, he will again vote against the ban. Republican Arizona Senate candidate Kari Lake also opposes a federal ban on abortion, which would cost her another vote.
Simply put, Republicans don’t have the votes in the Senate for a federal abortion ban. Why would Republicans pursue a federal anti-abortion bill that is 11 points down and has zero chance of passing in Congress?
President Trump is right to take the position that Republicans should not pursue a federal abortion ban. Even if Republicans hold a majority in the Senate in 2024, there is no chance of it passing. Instead, Republicans should talk more about policies that help create pro-abortion voters. -Instead of talking about the federal ban on abortion, talk about a pro-life, pro-family culture.
This would be in sharp contrast to Democrats who are truly radical on abortion, including a 2022 bill aimed at codifying Roe law that would allow up to nine months of abortion without restrictions. A majority of Americans oppose late-term abortion. As President Trump rightly pointed out, each country will address this issue.

Even red states like Ohio have passed abortion rights ballot initiatives. And Kansas voters rejected an amendment declaring that people do not have a right to abortion.
Republicans should focus more on policies that support families and women, rather than an unrealistic federal abortion ban. If this election turns out to be a referendum on Joe Biden, given his unpopular handling of the economy and border issues, Republicans are well-positioned to win. If it’s about abortion, things get muddy.
