A New York Court of Appeals judge on Tuesday rejected former President Trump’s attempt to delay his trial in the hush money case.
Judge Cynthia Khan issued the ruling, rejecting an argument by Trump’s lawyers that the trial should be delayed until the full bench can hear arguments regarding the gag order against the former president. The trial is still scheduled to begin on April 15th.
“The First Amendment damage caused by this gag order at this point is irreversible,” Trump’s attorney Emile Bove argued at Tuesday’s hearing.
Bove also said that if the prosecution’s two star witnesses, porn star Stormy Daniels and former lawyer Michael Cohen, routinely criticize Trump in public, Trump would be removed from office. He argued that he should not be subject to verbal abuse.

President Trump’s gag order, imposed by Judge Juan Melchán, prohibits him from speaking about jurors, witnesses or others at the trial.
Marchand agreed to the gag after Manhattan prosecutor Alvin Bragg argued in court that Trump “has a long history of making inflammatory statements in public.”

Trump and his lawyers filed a motion to have Marchan recused from the trial altogether, citing his daughter’s Democratic Party-affiliated political activities and alleged “hostility” toward potential 2024 Republican presidential nominees. submitted.

In response, Marchand last week expanded his order to include a ban on Trump speaking about his family.

Bragg alleges that Trump “repeatedly fraudulently falsified New York business records to cover up his criminal conduct in concealing information harmful to voters during the 2016 presidential election.”
