Appeals Court Leaves Hold in Place Against Oregon Gun Control

The Oregon Court of Appeals on Friday refused to overturn Harney County Circuit Judge Robert Raschio’s hold on certain state-level gun regulations.

December 9, 2022 statesman journal report Judge Raschio issued an injunction against Ballot Measure 114 (BM 114), blocking implementation of the permit-to-purchase rule and ban on “high-capacity” magazines.

The lawsuit against BM 114 was filed by Gun Owners of America and the Gun Owners Foundation.

Oregon Attorney General Ellen Rosenblum appealed Raschio’s decision, and on Friday, the Oregon Court of Appeals decided not to lift Raschio’s stay.

KGW8 I got it. The appellate court “pointed out as follows.” [BM 114] Not currently enacted, and never since passed in 2022, these suspensions are generally granted to maintain the status quo, not the contrary. ”

Additionally, the appellate court explained that part of the sentencing process includes reviewing the circumstances under which Oregon is likely to prevail in favor of BM 114 as the case moves through the system. The appeals court could not predict a victory for the state, saying both sides presented “good arguments” and that the final decision in the case could go either way.
