New York Democrats and other radicals are pushing forward with a ballot initiative that could ultimately pit the state’s bill of rights against conservatives, religious residents and others with gender ideology and opposition to abortion.
Current “vague” language proposed
New York State Law Amendment Equal Protection (ERA)The bill, championed by Planned Parenthood and various other left-wing groups, has some critics worried it could have devastating consequences beyond codifying abortion in the state constitution.

I got it. Some opponents have expressed concern that the ERA would allow children to change their gender without their parents’ consent, completely weakening the laws that currently protect children.
initiative
The ERA was introduced and ultimately passed by Democrats in both chambers of the state Legislature over the past two years, but its content would change significantly.
New York State Constitution Article 1, Section 11now provides that no person shall be subject to any discrimination in civil rights by any other person, corporation, corporation, agency, or nation on the basis of race, color, creed, or religion.
This initiative allows New Yorkers (now given the plural pronoun “he or she”) to It will be added that people should not be discriminated against. Expression, pregnancy, pregnancy outcomes, reproductive health care and autonomy.
Supporters
The ERA has been supported by a variety of left-wing, LGBT, and pro-abortion groups.
Another supporter of the ERA, Sen. Kirsten Gillibrand (D.Y.), framed the initiative last year as a way to help Democrats secure and hold power.
“A ballot initiative in our state would definitely help Democrats by increasing overall turnout,” Gillibrand said. Said New York Times. “The number one reason we lost our House seats was turnout.”
New Yorkers for Equal Rights, the ballot initiative committee promoting the ERA,
shown This amendment would prevent future democratically elected officials from passing anti-abortion laws in states that are already pro-abortion. Cutting off Medicaid funding for abortions. and ban private insurance from covering abortions.
The group has made it abundantly clear that this is an issue that will prevent future voters from changing their minds on abortion, and that former Republican Rep. Lee Zeldin’s unexpectedly close 2022 gubernatorial race cited as evidence of a “change in political winds.”
Gov. Kathy Hochul (Democratic Party) seems to have a similar idea, emphasizing that while laws can be repealed, “there is a much higher threshold for changing the Constitution.”
New Yorkers for Equal Rights said that in addition to preventing New Yorkers from changing their minds about allowing virtually unlimited abortion in the state, the ERA could also help “restore abortion rights nationwide.” He suggested that there was.
The group also hinted that the amendment would hamper efforts to keep LGBT propaganda out of classrooms.
according to For the Greater New York State Family Planning System, “The ERA was created to improve reproductive rights in New York in the wake of the U.S. Supreme Court’s unjustified decision to abolish the federal constitutional right to abortion established in Roe v. Wade.” This is an important step in securing access.”
Opponents
The Coalition to Protect Children urged New Yorkers to vote “no” on the ERA on November 5, noting that the state already has an Equal Rights Amendment.
“This new language may seem innocuous to the general reader,” CPK said.
state on that website. “But once you understand the practical legal implications of this poorly written, one-size-fits-all amendment, you quickly realize how absurd it is.”
CPK suggested that the ERA could be destructive to parental rights and weaken laws that protect minors from sexual abuse.
“If an entity cannot ‘discriminate’ on the basis of age, gender identity or expression, then under the new revised language, health care providers can make permanent, life-altering ‘gender-affirming’ decisions.” “Health care providers are not required to facilitate the child’s request to do so. Please consult with parents.”
The number of children who identify as “transgender” is exploded in recent years. The vast majority of children will outgrow this mess. But when parents are no longer able to act as thwarts of their children’s whims (as ideologues and profit-seeking medical professionals do), the ERA could greatly benefit the sex-reassignment system.
The CPK further states that “laws establishing legal ages for the purchase and/or consumption of alcohol and cannabis, and laws establishing elder abuse and statutory rape, can all be weakened because they ‘discriminate’ on the basis of age.” he pointed out.
spectrum news 1
report Some Republicans have expressed concerns about how this would affect the rights of religious New Yorkers.
“For those of us who take our faith and religion very seriously, we are very concerned about lawsuits against churches and against particular faiths and religions,” said Republican Rep. Chris Targ.
“Unfortunately, like so many other bills, this goes too far,” said state Sen. George Borrello, a Republican. “It’s very vague and very broad. At the end of the day, my biggest concern is that late-term abortion be codified into the New York state constitution.”
When Democrats pushed the initiative in Congress last year, Rep. Rebecca Seawright appeared to confirm Mr. Borrero’s suspicions. Says“We are closer than ever to enshrining a woman’s right to choose and equal protection against discrimination into our state’s most important governing document.”
