“This is supported by telephone data showing Mr. Koberger being in the countryside on several late nights and early mornings,” the document states. “The phone data includes numerous photos depicting the night sky taken at several different late nights and early mornings, including in November.”

The defense team plans to have experts prove that Koberger’s cellphone was located south of Pullman, Washington, and west of Moscow, Idaho, on the night of the murder.

But Gelman pointed out that Koberger’s DNA was found at the crime scene.

“The defense is trying to muddy the waters by trying to show just enough reasonable doubt for the jury to vote not guilty, but DNA doesn’t lie,” he said.
