Special Counsel argues against Hunter Biden trial delay

Federal prosecutors are asking a judge to deny Hunter Biden’s request to postpone his tax trial in California this summer, which is expected to be a busy summer for the president’s son. Biden also faces another criminal case in Delaware.

Special Counsel David Weiss said in a motion that Mr. Biden’s lawyers, who are representing Mr. Biden in the California and Delaware cases, agreed to a trial date in advance last year.

“Defendants who erroneously chose to file a nonjurisdictional appeal will not be granted a continuance, and this defendant should be treated in the same manner,” the motion states. However, none of this warrants a continuance and the motion should be denied. ”

Weiss said that even though the tax trial is scheduled to begin on June 20, Biden’s lawyers have agreed to begin the trial in Delaware in April 2023, and that Biden will He is charged with using a firearm. The trial in Delaware is scheduled to begin June 3.

“In his latest effort to delay the trial (motion for continuance), the defendant’s lead attorney’s main reason is a week-long trial in Delaware on June 3, 2024, where he is one of the attorneys representing the defendant on firearms charges,” court documents state. “However, on March 13, 2024 and April 11, 2024, the lead attorney advised the Delaware County Court that the trial would begin on June 20, He said gun cases could be heard in Delaware in 2024.

On Tuesday, a federal judge denied a request to postpone the gun case until September. U.S. District Judge Maryellen Noreika said she believed “everyone will be able to accomplish what they need to do” by the trial’s June 3 start date.

Later that day, a three-judge panel of the federal appeals court said the tax case against Biden could also move forward.

In Delaware, Biden is accused in October 2018 of lying about his drug use while filling out paperwork to buy a gun he had kept for 11 days. He pleaded not guilty.

In California, he is charged with three felonies and six misdemeanors over at least $1.4 million in taxes he paid between 2016 and 2019.
