An illegal immigrant who has already been deported and is accused of the execution-style murder of 25-year-old Ruby Garcia in March is set to stand trial in Grand Rapids, Michigan.
Brandon Ortiz Vito, a 25-year-old illegal immigrant from Mexico, was arrested and charged with murder, indecent assault, carjacking, carrying a concealed weapon and felony possession of a firearm in connection with the March 22 shooting death of Ruby Garcia.
On Wednesday, a judge in Grand Rapids Confirmed There was enough evidence to try Ortiz Vite for the murder of Garcia.
According to prosecutors, Ortiz-Vito and Garcia were in a relationship at the time of the killing. Prosecutors allege that Ortiz-Vito was driving Garcia’s car on U.S. Highway 131 when he pulled over the young woman and ultimately shot her four times — twice in the head, once in the arm and once in the hand.
After Garcia’s body was discovered on the side of the highway, Ortiz Vite contacted police on March 24, turned himself in and confessed to the murder.
“I called because I wanted to turn myself in. [for] “It’s a murder I committed two days ago,” Ortiz Vito allegedly told the dispatcher, according to prosecutors. “I know what I did was wrong and I’ll serve my sentence, but in my mind I just don’t want to die.”
Immigration and Customs Enforcement (ICE) officials confirmed that Ortiz-Vite is an illegal immigrant who was deported from the United States to Mexico in 2020.
Ortiz-Vite is charged with offenses dating back to 2020, with a warrant being issued for his arrest that year for failing to appear in court on charges of DUI and driving with a suspended license. He had previous run-ins with the law in 2017 and 2018.
Ortiz Vito is being held without bail at the Kent County Correctional Facility and faces life in prison without the possibility of parole. His trial date will be set at a later date.
