A federal judge in Texas has blocked the Biden administration’s attempt to expand Title IX protections to include “gender identity.”
Judge Reed O’Connor, appointed by President Bush, Domination On Tuesday, the Department of Education (ED) said the newly revised Title IX guidance usurps Congress’ authority and pursues an agenda that is inconsistent with Title IX’s original purpose. ED says The new rules prohibit schools that receive federal funding from “discriminating on the basis of gender stereotypes, sexual orientation, gender identity, or sex characteristics.”

Texas Attorney General Ken Paxton Sued He sued the administration over the rule in 2023, arguing that it illegally forces schools to adopt a transgender ideology or risk losing federal funding. The new rule would allow biologically male individuals to “use women’s restrooms, locker rooms and sports teams, and require students and teachers to use pronouns based on their gender identity rather than their biological sex,” he argued.

House Republicans are also working to repeal the new rules, with 68 Republicans challenging them through a bill introduced in June. according to The effort is being led by Republican Illinois Representative Mary Miller, according to a press release.
“Joe Biden is undoing years of progress made to guarantee women their rights under Title IX,” Miller said. In a press release “Yet the Biden administration is putting girls at risk by allowing men into women’s and girls’ bathrooms and locker rooms.”
ED was initially Introduced “Interpretation Notice” In June 2021, Title IX protections will include sexual orientation and gender identity.
