Former Assistant U.S. Attorney General Andy McCarthy on Monday called for a 25th Amendment hearing for Biden after Biden’s highly shaky performance in last week’s presidential debate left new questions about his mental acuity and ability to do his job, warning that the current “threat” environment is similar to that “just before 9/11.”
McCarthy, a Fox News contributor, made the comments after being asked on “Outnumbered” about a pattern of concerning behavior by the president, including his disastrous performance in last Thursday’s debate, in which the president appeared visibly troubled. in some casesMany times I find myself with my mouth wide open and unable to finish a sentence.

“I think it’s time to have hearings on the 25th Amendment,” McCarthy said. “I’m not really interested in campaigning on this issue. I started prosecuting jihadists in the 1990s. Today’s ‘threat’ environment is reminiscent of the period just before 9/11, except there was no war in Europe or the Middle East just before 9/11. Israel is now looking at a two-front war. It would be insane to have a non compos mentis person become president.”
Congressman Chip Roy (R-Texas) introduced legislation last week calling on Vice President Kamala Harris to bring together Biden’s cabinet members and jointly declare that Biden is ineligible to hold office.
Roy introduced the resolution on Friday, calling on Vice President Kamala D. Harris to “convene and mobilize key members of the Executive Branch of the Cabinet, invoke Section 4 of the 25th Amendment to the Constitution, and declare that President Joseph R. Biden is unable to discharge the duties of his duties and immediately exercise his powers as Acting President.”

The resolution argues that Biden has “repeatedly and publicly demonstrated his inability to carry out the powers and duties of the President, including the powers and duties of Commander in Chief.”
25th Amendment, Section 4 It gives the Vice President and a majority of the Cabinet the power to decide whether the President is fit to continue in office. If the Vice President and a majority of the Cabinet or Congress decide that the President is unfit to continue in office, the Vice President can assume the presidency.
“A lot of people are saying we should really invoke the 25th Amendment right now because this is an alarming situation,” House Speaker Mike Johnson said Friday. “Our adversaries, like all of us, see the weaknesses in this White House. I’m not comfortable saying that. I think this is a very dangerous situation.”
Biden has faced intense backlash in the days since the debate, with many prominent Democrats and commentators on the left voicing concerns about his mental state and ability to stand up to his opponents and calling for him to drop out of the race.

Concerned donors and Democratic “panic” Despite criticism of Biden’s performance, his campaign has so far been adamant that Biden, who has already secured the number of delegates needed to win the 2024 presidential nomination, will not back down.
Biden’s campaign has tried to explain away his performance by saying he had a cold on the night of the debate, and the president’s supporters acknowledge he had a “terrible night” but argue that a poor 90-minute performance doesn’t negate his legacy as president.
Former President Barack Obama acknowledged Biden’s failure to deliver strong results but criticized Trump while defending his former vice president.
“There will be bad debate nights, believe me, I know. But this election is a choice between someone who has spent their whole life fighting for ordinary people and someone who only thinks about themselves,” he wrote to X.
