Switchblade Carry Ban Violates 2A

The Massachusetts Supreme Court ruled Tuesday that a state law banning the carrying of switchblades violates the Second Amendment.

This incident Commonwealth v. David E. Canjula.

Kanjula was arrested on July 3, 2020, and a knife with a “spring-loaded blade” was found during a body search. The suspect was charged with “possessing a dangerous weapon,” among other crimes, but challenged the constitutionality of the ban on possession of switchblades in a “motion to dismiss before trial.”

He said, “The switchblade is an 'arm,' so [the] The ban on carrying switchblades violates the Second Amendment right to bear arms for self-defense.”

The Massachusetts Supreme Court is the U.S. Supreme Court Heller (2008) and Blue En (2022) ruling, “A central element of the Second Amendment is the 'inherent right of self-defense,' which is[s] “Give 'every American' the right, subject to certain reasonable and clearly defined restrictions, to bear commonly used weapons in public.”

They observed: Heller and Blue En In cases involving handguns, Second Amendment protections are not limited to firearms alone.”

They then noted that the Commonwealth “has not met its burden of demonstrating a historical tradition justifying the regulation of switchblades.”
