Jonathan Turley Says Smith ‘Stretched The Law’ With Superseding Indictment Against Trump

George Washington University law professor Jonathan Turley said Wednesday that special counsel Jack Smith “strayed from the law” by filing the indictment against former President Donald Trump.

The indictment filed Tuesday night contains the same four charges as Smith's original indictment, to be sentenced Aug. 1, 2023, related to Trump's alleged interference in the 2020 election. “This is classic Jack Smith. He's always pushed the envelope with his cases and sometimes pushed it past the limits. Turley said Smith did not make any major changes to the indictment, but merely tweaked it to remove the parts that would be considered “official business” performed by the former president on Jan. 6, 2021. The Supreme Court ruled 6-3 in a July 1 ruling that presidents are immune from prosecution for “official business” performed while in office, leaving Smith to consider which parts of the indictment would be considered official business.

“It reminded me of my favorite Italian beef stand in Chicago where a woman asked for something low calorie and the owner cut the sandwich in half and charged her full price. I think this is basically the same thing, the owner is basically charging full price and just offering less,” Turley said.

Trump Claimed In a post on Truth Social on Tuesday, Turley said Smith and the Department of Justice (DOJ) violated DOJ policy that states no action can be taken that could affect an election within 60 days of the election. Attorney General Merrick Garland did not enforce the rule against Smith, and the special counsel “does not feel bound by this order,” Turley said.
