The legal battle over the controversial Child Arrivals Deferred Action Program continues in court.
The current conflict includes arguments before the 5th Circuit Court of Appeals on Thursday, with several states, including New Jersey, facing off against the federal government and other parties.
The DACA program is about allowing undocumented immigrants who entered the United States as young adults to remain in the United States.

According to USA.gov, “DACA temporarily delays deportation of undocumented people who came to the United States as children.”
However, the policy was previously deemed illegal amid legal controversy.
A 2021 order signed by U.S. District Judge Andrew Hanen requires the Department of Homeland Security to “post a public notice within three calendar days of this injunction and update the Department's website and all other relevant agencies' websites. A U.S. district court has ruled that the DACA program is illegal.[.]”

But Hanen said the government was not directed at the time to revoke DACA status for recipients in good standing.
Similarly, Biden-era rules regarding DACA were also repealed.
In 2023, Hanen stated, “The court found that the final rule is subject to this court's (and the Fifth Circuit's) previous decisions, as well as the 2012 DACA memorandum that preceded it.The two programs There are no significant differences between the two. “We are extremely disappointed in the DACA ruling issued today by the Southern District of Texas,” White House Press Secretary Karine Jean-Pierre said in a September 2023 statement.
“On the first day of his administration, President Biden issued a memorandum directing the federal government to take all appropriate steps to “maintain and strengthen the DACA policy.'' Consistent with that directive, the administration This final rule protects us from legal challenges and codifies this long-standing policy,” Jean-Pierre said.
