FBI agent acquitted in 2020 train shooting arrested in Maryland for alleged sexual assault against 2 women

An FBI agent who shot and killed a man on a train nearly four years ago and was acquitted of attempted murder charges was arrested Monday in Maryland on charges of sexually assaulting two women.

Montgomery County police have arrested Special Agent Eduardo Valdivia, 40, and the Special Victims Unit is asking any additional victims to come forward. Police will hold a press conference on Tuesday to “encourage people to come forward,” the department said in a statement.

An FBI spokesperson said in a statement that Valdivia has been suspended by the FBI pending the conclusion of the Montgomery County Police Department investigation.

“The FBI takes allegations of criminal violations or misconduct very seriously,” the statement said. “As this is an ongoing investigation, the FBI cannot comment further.”

Valdivia was previously charged with attempted second-degree murder and other charges in connection with an off-duty shooting on a Red Line subway train near Bethesda, Maryland, in 2020, but was acquitted two years later. Ta.

He is suspected of having exchanged words with a man who demanded money. When Valdivia refused the money, the man turned away, muttering insults.

Valdivia then repeatedly told the man to back up before shooting him from a distance of about two to three feet, County Attorney Robert Hill said in court. Hill said the injured man had part or all of his spleen, colon and pancreas removed in surgery after the shooting.

The FBI agent was later charged with attempted second-degree murder, first-degree assault, use of a firearm in a crime of violence, and reckless endangerment.

Valdivia turned himself in after being indicted in 2021, but a jury found him not guilty on all charges in December.

Valdivia now faces new felony and misdemeanor charges, including two counts of second-degree rape, for incidents that occurred in May and September of this year, according to court records.

Robert Bonsib, the attorney who represented Valdivia in the train shooting case, confirmed that FBI agents were arrested on Monday on sexual assault charges.

“We will not accept any allegation head-on until we have all the evidence,” Bonsib said. Associated Press.

Bonsib said his client was ordered held in custody after an initial court appearance on Monday. Bonsib said Valdivia will be back in court Tuesday for a bail hearing before a judge.

Bonsib said Valdivia joined the FBI in 2011 and was promoted to supervisory special agent at FBI headquarters in 2019. Valdivia has been working for the FBI since his acquittal.
