A Missouri judge has upheld a ban on puberty blockers and hormone therapy for minors suffering from gender dysphoria.
in him 74 page judgment On Monday, Wright County Circuit Court Judge Craig Carter wrote that treating transgender minors would be an “ethical minefield” for treatments that are not scientifically established.
“Medical professionals appear to be standing in the middle of an ethical minefield when it comes to the ethics of gender-affirming treatments for adolescents, with little evidence to guide them,” he wrote.
Citing Supreme Court precedents that give lawmakers broad discretion in areas “fraught with medical and scientific uncertainty,” Wright said, “Medical ethics in the treatment of adolescent gender dysphoria are almost entirely unclear. There is a lack of consensus.'' around missouri independent:
Plaintiffs in the case, which includes gender-affirming health care providers, transgender minors and their families, find the law “clearly and unquestionably in violation of the Constitution.” There was a burden of proof, the judge wrote. And because the plaintiffs challenged the entire law, they had to prove that “there is no set of circumstances that would give effect to the provision.”
During a nine-day trial in late September, experts from both sides weighed in on the availability of scientific research on gender-affirming care. Carter noted that the plaintiffs agreed that the standard of care was based on scientifically low-quality evidence. Expert witnesses for the plaintiffs said during the trial that they felt there was still enough to justify the treatment field.
Carter also pointed out that minors cannot even buy a six-pack of beer or a pack of cigarettes.
“If you're not going to let a 16-year-old buy a six-pack of beer and a pack of cigarettes, or if you're not going to let an adult buy those items, you need to allow that same child/parent team to make changes for the teenager.” Is there? Sex forever?'' Carter wrote.
The ACLU of Missouri and Lambda Legal said the “alarming” ruling could lead to discrimination against transgender youth.
“The court’s findings signal an alarming acceptance of discrimination, ignore extensive court records and the voices of transgender Missourians and their caregivers, and “Denies Medicaid recipients the right to access evidence-based, effective, and frequently life-saving medical care,” the legal groups said in a joint statement.
Missouri Attorney General Andrew Bailey said: on X “The public mood on this issue has changed significantly since we began our investigation.”
“What systems does the country need to put in place to protect children and make adults and patients understand that there is a lack of science and medicine behind certain procedures that are recommended? It has a role to play in deciding.”
The case is Noe vs. ParsonNo. 23AC-CC04530, in the Circuit Court of Cole County, Missouri.
