A judge in Delaware has dismissed a lawsuit against Fox News brought by an Arizona man who is at the center of the conspiracy theory that led to the January 6, 2021, attack on the Capitol.
Former U.S. Marine Ray Epps sued Fox last year, accusing the network of knowingly promoting what his lawyer called a “subversive conspiracy theory” about involvement in the riot.
Epps was sentenced to one year of probation for his role in the insurrection after pleading guilty to disorderly or disruptive conduct in a restricted building or grounds after the Capitol attack.

Epps was a federal employee who was at the center of a conspiracy theory that claimed he incited violence to portray former President Trump's supporters in a negative light. This theory was promoted by many right-wing media figures in the months following the attack, including former Fox host Tucker Carlson.
