‘Bragg Is the Worst District Attorney in Modern New York History’

During Friday's broadcast of FNC's “Hannity,” Harvard Law Professor Emeritus Alan Dershowitz said that the New York City jury trial in the Daniel Penny case remained deadlocked and that Manhattan District Attorney Alvin Bragg I expected that I might lose the case.

Dershowitz said such a defeat, coupled with defeats in prosecutions against President-elect Donald Trump, would likely result in a loss to re-election.

Dershowitz said Bragg was “the worst district attorney” in modern New York history.

“Professor Dershowitzin a power relationship like this, at some point when it's even, he tells the jury, it has to be another jury, and if it doesn't come to a conclusion there's going to be another trial and there's going to be another jury. I said it would happen. They’re going to do their job,” said substitute host Tammy Bruce. “However, there is no guarantee that there will be a new trial, and it is possible that prosecutors may decide not to hold another trial. At this point, it again appears that there is some kind of coercion directed at the jury. Masu.”

“Well, I think it's manipulation,” Dershowitz replied. “It's a manipulation by prosecutors. Look, the commentators who protested were absolutely right. This is a case about racism. It's about racism by the district attorney. If the racial composition had been reversed, no one would have brought this case forward. This is racism because it would not have happened to a black man. There won't be any demonstrators outside protesting that he was convicted of murder for strangling a white man. This is all about race, which is why this is a jury. It's an attempt to manipulate him into reaching a compromise verdict, but I think it will fail.”

“My prediction right now is that the jury is going to be deadlocked on the sub-case because, as the judge pointed out, judging by the notes he's seen and heard, this is a two-person jury. Because it seems to be about a disagreement between things, justification — was he justified in doing this and the causal relationship, did he actually cause the death? ” he continued. “And these issues are the same whether the count is high or the count is low. And even if you're retried, you can't be tried again on a higher charge. That becomes double jeopardy. So I think the question is, does the operation work, and if we get enough jurors to — well, you know, no, he committed negligence, not manslaughter. I did–well, let's give the prosecutor a victory.”

“Also, don't forget that prosecutors are running for re-election. If they lose this case and lose Trump's case, they won't be able to get re-elected. If Trump is granted an appeal, we will appeal.” Dershowitz added. “Look, Bragg is the worst district attorney in modern New York history. It's an office filled with great people. Thomas Dewey was district attorney. Morgenthau was district attorney. Hogan was district attorney. These are great DAs, but now Bragg Oh my God, he brought the office down to the lowest level possible, diminished all New Yorkers' respect for what was once a great office building in the Hogan Building, and made sure it would never be called the Bragg Building again. It will go away, I guarantee it.”
