Immigration Customs Enforcement (ICE) highlights the rise in illegal immigrant arrests under President Donald Trump, but the agency is currently working on space restrictions for criminal immigrants who are detained.
“It has a massive amount of these lofty goals,” said Hector Quilog, an expert immigration lawyer in Spokane, Washington.
“There's a problem with the number one, the number of detention centres and the number of beds available,” he said. “Like it or not, some individuals need to hear their hearing and wait somewhere, which is why there is a problem with their ability.”

Since President Trump took office on January 20th, ICE has significantly strengthened its executive business.
On January 23, ICE conducted a coordinated assault in major U.S. cities, with 538 individuals being detained. The operations continue at a high pace. For example, on January 29th, ICE arrested 956 individuals, marking the highest daily arrest number under the Trump administration.

Congress funded ICE in 2024 to have 41,500 beds, costing around $3.4 billion a year.

“We need some priorities after that,” Quirog said. “Who do I keep and who do I release? Well, I want to hold people with criminal history. Others need to be released or checked in with an ankle bracelet.”
“The detention and beds and who we are trying to hold are practical issues that the administration has to face pretty quickly if they want to reach the numbers promised in the campaign,” he said.

Ongoing space constraints have led authorities to set up tents at US Navy Base in Guantanamo Bay. However, the two U.S. defense secretaries told Fox News that none of the 195 beds prepared to house immigrants were used because they didn't meet ice standards.

As of Wednesday, only 20 migrants were in custody at the base. The 16 “illegal threat aliens” are held in part of the base's detention facility, also known as Camp 6, where four immigrants are detained at the backup facility due to insufficient tents.
DHS and ICE have not responded to inquiries regarding the criteria used to assess whether immigration is a high threat.

ICE says it will require an additional $3 billion as it will require an additional 60,000 detention beds. The additional beds will be driven in part by the passage of the Laken Riley Act, which requires DHS to be detained for illegal immigrants arrested for wage-related crimes.
“The Laken Riley Act requires EROs to detain those non-citizens immediately, so the ERO requires a minimum of 64,000 additional detention beds, which does not take into account other immigration enforcement mandates that require an increase in detention capacity from the ICE, in response to questions from R-GA lawmakers.”

In Congress, Republicans are preparing to make major funding changes through the budget adjustment process. Given the salience of the issue in the 2024 election, border security and internal enforcement will likely be a top priority for Republicans.
