President Donald Trump claims that the deported Venezuelans are members of the prison gangster Tren de Aragua, which he designated as a foreign terrorist organization.
The White House issued the Trump Declaration on Saturday to summon the alien enemy law of 1798 to declare that gangs were engaged in an irregular war against the United States, Reuters reported.
Later on Saturday, US District Judge James Boasberg issued an order blocking deportation, but the flight continued anyway, with 261 people flying to El Salvador.
Lawyers for the Trump administration argued that the judge's initial oral ruling to block flights was replaced by a sparse written order issued later, with the government having the legal right to continue flights after leaving space.
Since taking office in January, Trump has tried to push the boundaries of executive power, challenging historical checks and balances between the US branches of the government.
