A judge in Tacoma, Washington (approximately 2,800 miles from Washington, DC) issued an injunction against the ban on military traffic identification members. This was ban ordered by President Donald Trump's commander, and was attempted by Secretary of Defense Pete Hegses.
On Thursday, Judge Benjamin decided on Settle, the appointee of George W. Bush and former captain of the US Army Judge Advocate – decided that Trump's Order They discriminated against seven plaintiffs, all of which are traffic identification members of the US military. They are led by the US Navy CMDR. Emily “Hawking” Shilling, a 42-year-old man pretending to be a woman.
“The government … does not provide evidence to support the conclusion that military preparation, unit aggregation, lethality, or any other touchstone phrase that has long been used to exclude various groups from services is in fact negatively affected by open transgender services,” Settle wrote. Opinions on page 65.
“The government's argument is unconvincing and is not a particularly close question about this record.”
The government sought a resolution to limit the injunction to plaintiffs alone, but Settle declined, arguing that the district court “has considerable discretion in ordering appropriate, impartial remedies.”
“This is a rare case of guaranteeing a national injunction,” Settle argued.
“The adoption of individual gender identity is inconsistent with the soldier's commitment to an honorable, true, and disciplined lifestyle.”
Settle's injunction comes shortly after a similar injunction by Biden District Ana Reyes, which Washington, DC Reyes issued an injunction last week, and then handed it a temporary stay in it and lifted it again. It is currently scheduled to come into effect on Friday.
As expected, radical activists are celebrating low-level, unelected judges who interfered in the decision of the democratically elected president and the Secretary of Defense who passed scrutiny of democratically elected presidents and democratically elected senators.
“Today, the court's decision confirms that this ban on transgender people serving in the military is not only unconstitutional,” Sarah Warbellow said. Human Rights Campaign Foundation.
“Transgender service members have been openly and honorable for many years. Politicizing their services is a step away from the views of the American people, compromising military preparation and making America safe.” Sarah Kate Ellis He said this in response to Reyes' ruling.
“They can do the right number of pull-ups. They can do the right amount of push-ups. They can shoot straight,” he said. Sasha Bucharta lawyer for Lambda Legal said Monday. “But they are told they have to simply leave the army for who they are.”
Buchert's comments focus primarily on the physical capabilities of identifying service members, with men pretending to be women likely to pass physical fitness standards. However, such statements shun the main arguments made in Trump's EO for trans-specific service members who questioned their mental well-being and “honor.”
“Expressing false 'gender identity' from an individual's gender cannot meet the strict standards required for military service. Beyond the hormonal and surgical medical interventions involved, the adoption of gender identity that contradicts an individual's sexual conflict is contradictory with its commitment to honor, truth, and to the law with a distinctive lifestyle.
“It is a man's claim that he is a woman, and his requirement for others to respect this falsehood is not consistent with the humility and selflessness required of a service member.”
Settle proposed in his decision that the government used outdated data on traffic identification services members.
The government is expected to appeal Settle's ruling, as it has already done with Rays.
