Lawyers acting on Hamas' behalf are challenging the UK government to classify it as a terrorist organization, and instead a movement of resistance and should be listed.
Hamas became a generally banned organization in 2021, as the British government had listed Hamas' military wings as a terrorist organization since 2001 and later thought there would be no meaningful differences between it and the rest of the organization.
This is a humiliation against their human rights, arguing a new legal challenge to force the government to remove Hamas. Under British law, anyone who sympathizes with or shows sympathy for a prohibited organization could be breaking the law.
Under a challenge called the Hamas Incident, led by Riverway Act Fahad Ansari, it is allegedly acknowledged that terrorists are violating the European Human Rights Treaty. This argument states that preventing the British from supporting Hamas is a humiliation for their freedom of speech, and Hamas is not a threat to Britain anyway, so such a ban is disproportionate.
The assignment includes dozens of submissions, including the Hamas Manifesto, Hamas Documents of General Principles, and Hamas Struggle, among other official Hamas documents.
Instead, Hamas is an “organized resistance movement in which Palestinians exercise their right to resist Zionism and colonization, occupation, apartheid and genocide.”
The time of London Note The challenge states that by legally classifying Hamas as a terrorist, the UK has fallen into a “moral and legally unprotected policy of siding with Zionist oppressors against the oppressed Palestinians.” To do so, the lawyers involved in the task have not been paid to represent Hamas, as it is against British law.
The legal submission appears to have further departed from the general principles of accuracy in classifying Hamas as a prohibited group in the UK, apparently attempting to litigate UK foreign policy. It stated:
For over a century, the British state has been responsible for Palestine colonization, ethnic cleansing and apartheid. Harakat al-Muqawamah al-Islamiyyah (Islamic resistance movement or “Hamas”) is an organized resistance movement in which Palestinians exercise their right to resist Zionism and colonies, occupation, apartheid, and genocide carried out under that name.
Hamas' continued ban means supporting the relentless colonization of Palestine and the relentless colonization of crimes against humanity and the relentless colonization of genocide practices carried out by the Geonist state. Its support and accomplice cannot be reconciled with the British state's obligations under both international and domestic law.
