The American Civil Liberties Union (ACLU) is taking legal action against President Trump’s administration in federal court for its targeting of international students whose immigration status has been terminated.
“The consequences of the defendant’s unilateral and unlawful termination are severe. Such dismissals remove students from their lawful student status. The plaintiffs and affected groups face the risk of immigration detention and deportation. They are also confronted with significant financial and academic hardships. Class action lawsuits have been initiated in New Hampshire.
“Indeed, the defendants’ unilateral and unlawful termination occurred in the middle of the study period (and during the semester), often incurring high costs and seriously interrupting the educational paths of students who have invested significantly while adhering to all necessary regulations in the United States.”
International students enrolled at colleges and universities in the U.S. either have lost their legal status or had their F-1 student visas canceled. Approximately 1,100 students from over 170 institutions have been impacted since late last month due to Trump’s immigration enforcement actions. This has been reported.
International students have responded by filing lawsuits in states like Wisconsin, Montana, and New Hampshire, successfully obtaining temporary restraining orders preventing their deportation.
“The American Civil Liberties Union seems overly focused on safeguarding foreign students rather than American civil liberties and national security. They might want to reconsider their name. Holding a visa to live in the United States is a privilege,” stated Tricia McLaughlin, deputy director of the Department of Homeland Security, in a statement to The Hill. “When individuals violate our laws and support violence and terrorism, that privilege ought to be revoked, and they should not remain in this country.”
McLaughlin further noted, “For inquiries related to specific cases involving visa revocation or individual statuses, the DHS supports the actions of the State Department.
Secretary of State Marco Rubio mentioned last month that over 300 student visas had been canceled, with numbers increasing daily.
International students participated in on-campus protests against the Israeli military actions in Gaza and sought visa applications. However, some foreign students with criminal records were also targeted.
“We do not delve into statistics or figures. We do not disclose the reasoning behind individual visa decisions. What we can state is that the department regularly cancels visas to secure our borders and ensure the safety of our communities.
