A federal judge recently mandated that the Trump administration expedite the resettlement of approximately 12,000 refugees in the U.S., in response to a court order that partially overturns the executive order aimed at suspending refugee enrollment.
US District Judge Jamal Whitehead, appointed by former President Joe Biden in 2023, issued this ruling despite a prior hearing where he hinted at needing to appeal an order concerning the treatment of thousands of individuals, which involved the disposal of 160 refugees already in the country.
“This court will not allow the government to reshape its outcome-driven judicial order. Sure, the government can pursue further clarification from the Ninth Circuit, but it cannot disregard statutory and constitutional law, nor the direct orders from this court and the Ninth Circuit,” he stated.
Trump’s executive order aimed to halt refugee resettlement processes and required the Department of Homeland Security to provide a report within three months regarding their interests in the matter.
In a previous decision in February, Whitehead had blocked the administration’s attempt to suspend refugee admissions in light of a lawsuit from organizations assisting refugees. He emphasized that Trump’s actions represented a significant override of Congressional authority concerning the national refugee program.
Whitehead instructed the administration to resume processing cases for refugees safeguarded by court orders within a week. He also directed the government to facilitate the entry of refugees whose medical and security approvals have not expired.
