Barasso Questions White House Habeas Group’s Viability
Senate Majority Whip John Barasso (R-Wyo.) expressed skepticism that the proposed White House habeas group will reach Congress.
During an appearance on NBC’s “Meet the Press,” host Kristen Welker noted that President Trump and his administration are actively working to halt the residential corpus as part of their immigration enforcement efforts, as mentioned in a recent statement by Deputy White House Director Stephen Miller.
The concept of habeas corpus requires authorities to present detained individuals and justify their confinement.
Initially, Barasso sidestepped questions, claiming that Trump would “follow the law” and reiterated his support for the president.
When pressed by Welker about whether he would vote to halt the habeas corpus initiative, Barasso reiterated his belief that the president would adhere to legal standards.
Despite Welker’s repeated requests for a straightforward yes or no regarding the habeas corpus pause, Barasso maintained that he doesn’t think the proposal will make it to Congress.
“I don’t believe this will come to Congress,” he asserted. “What I trust is that the president will follow the law, which he has stated repeatedly.”
The habeas corpus discussion is particularly relevant for immigrants facing deportation under the Foreign Enemy Act, having been invoked in cases involving detained individuals like Rümeysa Öztürk and Mahmoud Khalil.
It’s worth noting that this law is infrequently applied, often referenced in relation to 18th-century power structures used against Venezuelan nationals alleged to be gang members in El Salvador’s notorious Mega Prison.
Former federal prosecutor Jeffrey Tubin labeled the proposal as “a step into uncharted territory.”
“Abraham Lincoln did something similar during the Civil War when Congress was not even in session to ratify his actions,” he noted on Saturday.
Journalist Maggie Haberman also criticized the initiative, suggesting it aims to instill fear among immigrants and intimidate the judiciary.
