Federal Judge Blocks Trump’s Dismissal of Committee Members

A federal judge has halted President Donald Trump’s attempt to remove two Democrats from the Privacy and Civil Liberties Monitoring Committee. This decision emerged after Trump had dismissed all three Democrats on the committee in February, which led to two lawsuits being filed. According to U.S. District Judge Reggie Walton, allowing such unilateral firings would hinder the board’s ability to fulfill its mission.

In his ruling, Walton noted that granting the president such authority would undermine the board, which is intended to provide oversight for Congress and the public regarding federal counterterrorism strategies.

The committee was established by Congress to ensure that counterterrorism efforts are compliant with the Privacy and Civil Liberties Act.

Walton expressed concern that permitting an unchecked dismissal represented an overreach of executive power, which would shield administrative counterterrorism activities from scrutiny. Following Trump’s actions, only one Republican remained on the board, with the third Democrat’s term nearly over at the time of her removal; she opted not to pursue legal action.

In the ongoing lawsuit, plaintiffs Travis LeBlanc and Edward Felten contended that board members should only be terminated for valid reasons. However, Trump’s administration countered that creating such safeguards without Walton’s explicit permission would be inappropriate, insisting that members appointed by Congress generally possess clear employment protections.

White House spokesperson Harrison Fields emphasized that the Constitution grants the president authority to remove personnel executing enforcement duties. Fields expressed confidence in an eventual legal victory regarding this matter.

The plaintiffs highlighted that the remaining board’s composition, with just one Republican, fails to meet the quorum necessary for the committee to operate properly.
