Civil Rights Complaint Claims Male Student Changes Gender to Observe Girls Changing While Competing in Boys' Sports

Federal Complaint Against School District Over Gender Identity Policy

The Independent Institute (DFI) has lodged a civil rights complaint with federal authorities against the South Colony Central School District (SCCSD) in New York. The grievance focuses on a situation where male students frequently change their gender identity throughout the school day, allowing them access to girls’ bathrooms and locker rooms.

In this case, a high school boy, who competes on boys’ track teams and wears boys’ uniforms, claims a trans identity to use girls’ facilities during school hours. Some girls have reported feeling uncomfortable, stating the boy was “glaring at them” while they changed. The complaint under Title IX claims the school was “deliberately indifferent” to the harassment the girls faced from this boy.

When approached, the district responded to the Daily Caller News Foundation, saying, “We cannot comment on the issues of individual students due to privacy laws,” but assured that they have addressed the situation as necessary. SCCSD also referenced state laws mandating that schools must respond to issues related to “gender identity.”

New York laws like the Dignity for All Students Act and the Gender Expression Non-Discrimination Law prohibit discrimination based on gender identity. Additionally, these laws require that all single-occupant bathrooms in schools and most public facilities be marked as gender-neutral.

A spokesperson for the district added, “Submission of a complaint or investigation of a complaint will not change the district’s approach or procedures. All concerns raised were addressed through appropriate channels, and students received reasonable accommodations when necessary.”

Kevin Martin, a father of a student at SCCSD, expressed his concerns, stating, “My daughter and her teammates have the right to feel safe in their locker rooms.” He believes the school has failed to provide that security, indicating it’s unfair that his daughter had to resort to filing a federal complaint to protect her privacy in the locker room.

Reports suggest that several female athletes faced consequences for trying to change in alternative locations, like private stalls or designated “all-gender” bathrooms situated on various floors of the school.

The policy supporting gender identity rights has raised alarms for some, who argue that it leads to scenarios where male athletes dominate female competitions. There have also been concerns about registered sex offenders potentially being allowed in situations where they can observe young girls changing.
